Our platform is designed to assist founders of private technology companies and other private businesses in exploring fundraising opportunities, liquidity solutions, and strategic capital relationships prior to liquidity events such as acquisitions or public offerings. Unless otherwise specified, all references to our services include the content, applications, files, features, functionality, software, text, displays, images, video, audio, design, selection, information, recommendations, email notifications, direct messages, and other mediums, or portions of such mediums, that Fundraisly provides on or through the Website, whether as a visitor or a registered user (collectively,“Services”). The term “user”, “you,” or “your” refers to the user of our Website and our Services.

1. Information Provided Directly by You

We collect information you provide directly to us, such as when you request information about our Services, create or modify your Fundraisly account, purchase a Service Plan, register for a newsletter, make a purchase, request Services, complete a Fundraisly form, survey, questionnaire or application, contact customer support, join or enroll for an event or otherwise communicate with us in any manner. This information may include, but is not limited to, your name, business title, date of birth, e-mail address, business name, and physical address.

 

2. Information Collected Through Your Use of Our Services

We may collect certain information about you automatically when you visit or use our Services, or when you interact with emails, promotions, advertisements, or other electronic messages we send to you through the Services. This information may include your IP address, device characteristics (including device identifiers), web browser characteristics, unique identifiers, and other data stored in cookies, operating system details, language preference, referring URLs, length of visits, pages viewed, and other information that may be automatically accessible to us from your browser or device. The following are situations in which you may provide Personal Information to us:

  1. When you fill out forms or fields while using our Services;

b. When you register for an account with our Services;

c. When you enroll in an available paid Service Plan;

d. When you provide your company profile, including, but not limited to, company name, sector, stage, and description; investment amounts made, sought, or received; target investment areas and capital allocation; and additional investor or founder preferences and profile information.

e. When you order products or our Services, or through our Services from our affiliates or advertisers;

f. When you provide responses to a survey or questionnaire;

g. When you join or enroll in an event through our Services;

h. When you register for any newsletters, forums, or other materials through our Services;

i. When you provide information to us through a third-party application, service, or website;

j. When you communicate with us or request information about us or our products or our Services, whether via email or other means;

k. When you participate in any of our marketing initiatives, including events, contests, or promotions, and

l. When you participate in forums, reviews, or provide or post user-generated content as defined in our Terms of Service, or other submissions.

We may also automatically collect non-personal information through various technologies, including, but not limited to, cookies, web server logs, tags, SDKs, tracking pixels, local storage, Scripts, APIs, session replay, screen capture, and other similar technologies. This information helps us better understand how visitors use our Services and allows us to administer and customize the Services to improve your overall experience.

 

3. Information Collected from Other Sources, Including Third-Party Networking Sources

a. We may also receive information from other sources and combine that with information we collect through our Services. For example, if you choose to link, create, or log in to your Fundraisly account with a networking service, or if you engage with a separate application or website that uses our API, or whose API we use, we may receive information about you or your connections from that website or application. This includes, without limitation, profile information, profile picture, gender, username, user ID associated with your networkaccount, age range, language, country, friends list, your contact names, e-mail addresses, phone numbers, and other identifiers, and any other information you permit the networking service to share with third parties. The data we receive depends solely on the privacy settings you selected with the networking service. You agree that you have read the third-party networking service Terms of Service and Privacy Policy, authorize Fundraisly to access certain information about you that is made available through that third-party networking website, and further authorize us to collect, store, retain, and use Personal Information in accordance with our Privacy Policy.

b. Fundraisly relies on the accuracy and lawfulness of information provided by third-party platforms and does not independently verify such information. To the extent permitted by applicable law, Fundraisly disclaims liability for inaccuracies or unlawful disclosures originating from third-party sources.

 

4. Email and Third-Party Account Integrations

a. Fundraisly’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Data obtained through Google APIs will not be used for advertising purposes or transferred to third parties except as necessary to provide the core functionality of the Services. For purposes of this section, “Google user data” means any data obtained through Google APIs, including Gmail metadata or related account information made available through authorized integrations.

b. Access to information obtained through Google APIs is restricted to authorized Fundraislypersonnel and only where such access is necessary for security purposes, troubleshooting, legal compliance, or to provide user-requested support.

c. Fundraisly may allow users to connect third-party accounts such as Google Gmail, Microsoft Outlook, or professional networking platforms to enable certain features of the Services.

d. Where permitted by the user, Fundraisly may also access limited professional profile information or connection data from such networking platforms to support features within the Services.

e. Where a user authorizes such integration, Fundraisly may access limited information from those Services through secure APIs. For example, where permitted by the user, we may access email metadata (such as sender and recipient information, timestamps, and subject lines) and, where strictly necessary to provide a specific feature of the Services and explicitly authorized by the user, limited portions of email content. This information is used solely (i) to provide the functionality of the Services requested by the user, (ii) to support features directly related to such functionality, including identifying potential professional connections and facilitating introductions within the platform, and (iii) is subject to appropriate technical and organizational safeguards.

f. Fundraisly may use automated processing tools, including machine learning and large language model (LLM) technologies provided by third-party service providers acting on our behalf, to analyze (i) email metadata, (ii) where applicable, authorized email content, and (iii) communication patterns (such as interaction frequency, timing, and network relationships) in order to provide and improve the functionality of the Services, including assessing potential professional connections and improving connection recommendations within the platform. Such processing is limited to what is necessary to provide the Services. Fundraisly does not use such data (i) to train generalized artificial intelligence or machine learning models unrelated to the Services, (ii) to build user profiles unrelated to the Services, (iii) for advertising purposes. Access to email content is restricted and is not permitted for human review except:

i. where the user explicitly requests support,

ii. where necessary for security or abuse investigation, or

iii. where required by applicable law.

g. Fundraisly does not use data obtained through Google APIs or similar integrations for advertising purposes or to build profiles unrelated to the core functionality of the Services.Information obtained through such integrations is retained only for as long as the user maintains an active account or subscription and is deleted or anonymized following termination of the user’s account, except where retention is required by law.

h. Fundraisly does not sell, rent, or transfer Google user data to third parties except as necessary to provide the core functionality of the Services or to comply with legal obligations.

i. Fundraisly does not use Google Workspace API data to develop, improve, or train generalized artificial intelligence or machine learning models unrelated to the core functionality of the Services.

j. Fundraisly does not allow humans to read Gmail data unless:

iv. The user explicitly requests support,

v. It is necessary for security or abuse investigation, or

vi. It is required by applicable law.

 

5. Aggregated Data

a. We may collect, use, and share “Aggregated Data” (such as statistical or demographic data) for any lawful purpose. Aggregated Data is de-identified or anonymized and does not constitute Personal Information, as this data does not directly or indirectly reveal your identity. If we ever combine Aggregated Data with your Personal Information so that it can, directly or indirectly, identify you, we treat the combined data as Personal Information and will use it only in accordance with this Privacy Policy.

b. Fundraisly may use Aggregated Data or anonymized data for any lawful business purpose, including product development, benchmarking, analytics, research, and marketing. Such data does not identify any individual and is not treated as Personal Information. Where de-identified data could reasonably be re-identified, Fundraisly will treat such information as Personal Information in accordance with this Privacy Policy and applicable law.

 

6. Cookie Policy, Log Files, and Anonymous Identifiers

a. When you visit or use our Services, we may send one or more Cookies, small data files, to your device to uniquely identify your browser and let us help you log in faster and enhance your navigation through the platforms. “Cookies” are text-only pieces of information that we may transfer to an individual’s device for record-keeping purposes. A Cookie may convey anonymous information to us about how you browse the Services so we can provide you with a more personalized experience. Cookies may collect or be associated with identifiers and other information that may constitute Personal Information under applicable law.

b. Cookies allow our Services to remember information that makes your use our Services more convenient. A Cookie will typically contain the name of the domain from which the Cookie has come, the “lifetime” of the Cookie, and a randomly generated unique number or other value. Certain Cookies may be used on the Website regardless of whether you are logged in to your account or not.

f. When we use session Cookies to track the total number of visitors to our Website, this is done on an anonymous, aggregate basis (as Cookies do not, in themselves, carry any Personal Information).

p. When you use our Services, we may employ Web Beacons (also known as clear GIFs or tracking pixels) to anonymously track online usage patterns. No Personally Identifiable Information from your account is collected using these Web Beacons.

Please note that the Cookies and similar tracking technologies may change over time, and new Cookies or similar tools may be added. Where applicable, we will update this table to reflect material changes.

8. Device Information

When you use our Services through your mobile phone or other digital devices, we may collect information regarding and related to your device, such as hardware models and IDs, device type, operating system version, the request type, the content of your request, and basic usage information about your use of our Services, such as date and time. In addition, we may collect information regarding application-level events and associate that with your account to provide customer service. We may also collect and store information locally on your device using mechanisms such as browser web storage and application data caches.

 

9. Call and SMS Data

a. In connection with providing our Services (if available), we may receive call data, including the date and time of the call or SMS message, the parties’ phone numbers, and the content of the SMS message. Such data is processed solely for the purpose of providing and supporting the relevant functionality of the Services.

b. You are responsible for ensuring compliance with applicable telecommunications, marketing, and consent laws prior to initiating or participating in any call or SMS communications through our Services. Fundraisly does not control and is not responsible for the content of communications initiated by users.

 

10. Children's Privacy

We do not knowingly collect personally identifiable information from persons under the age of 13 in the United States (“U.S.”), or under the age of 16 in the European Union (“EU”), the “Protected Age”,unless we receive consent to do so from a parent or a legal guardian. If you are under the Protected Age, please do not provide us with information of any kind whatsoever. If you have reason to believe that we may have accidentally received information from a child under the Protected Age, without receiving the consent of a parent or legal guardian, please contact us immediately. If we become aware that we have inadvertently received Personal Information from a person under the Protected Age, we will delete such information from our records.

 

11. Protective Measures We Use 

a. We protect Personal Information using commercially reasonable technical and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure, and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls. Although we take measures to secure Personal Information, we do not promise, and you should not expect, that your Personal Information, searches, or other information will always remain secure. We cannot guarantee the security of our information storage, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet, including, without limitation, email and text transmissions. In the event that any information under our control is compromised as a result of a security breach, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps in accordance with any applicable laws and regulations.

b. No method of transmission over the Internet or method of electronic storage is completely secure. To the fullest extent permitted by applicable law, Fundraisly shall not be liable for unauthorized access to or loss of Personal Information that does not result from Fundraisly’s failure to implement reasonable security measures. Nothing in this section limits or excludes liability where such limitation is prohibited by applicable law.

 

12. Payment Information 

Fundraisly may now or in the future accept payments on our Website using a secure third-party payment processing gateway to collect, store, and process payment information. That information will be provided directly to the third-party payment processors whose use of your Personal Information is governed by their Privacy Policy. Fundraisly will not store this information on our Website or on our servers. Please contact the third-party payment processor if you have any questions.

 

13. How We Use Information We Collect 

We will not rent, sell, lease, or trade Personal Information to anyone unless you grant us explicit permission for this information to be shared in that manner. Our primary purpose in collecting, holding, using, and disclosing Personal Information is for our legitimate business purposes and to provide you with a safe, smooth, efficient, and customized experience. We will use this information in order to:

a. Operate the Website and provide our Services;

b. Improve our internal operations, systems, products, and Services;

c. Provide users with customer support, including sending you related information, including confirmations, technical notices, updates, security alerts, and administrative messages;

d. Understand you and your preferences to enhance your experience using our Services;

e. Analyze, improve, and manage our Services and operations;

f. Contact you for administrative, account maintenance purposes;

i. Enforce our Terms of Service, and any terms and conditions of any agreements for our Services, including, without limitation, our Master Service Agreement and Service Plan Addendum as defined in our Terms of Service agreement;

j. Send you communications we think will be of interest to you, including information about our Services, products, promotions, events, and news about Fundraisly;

k. Verify your identity and prevent impersonation, spam, or other unauthorized or illegal activity, including, without limitation, infringement of intellectual property rights of third parties.

We may process Personal Information as necessary to protect our legal rights, enforce our agreements, prevent fraud or abuse, comply with legal obligations, and otherwise operate our business in accordance with applicable law. Nothing in this Privacy Policy shall be construed to limit Fundraisly’s ability to use Personal Information where permitted by law.

 

14. How We Share Information We Collect

a. We share the information we collect about you as described in our Terms of Service and this Privacy Policy, or as described at the time of collection or sharing, as follows:

vii. With third-party Service Providers to enable them to provide the Services you request. Access to your Personal Information by these Service Providers is limited to the information reasonably necessary in order for them to perform their limited function for us. We also require that these Service Providers (a) protect the privacy of your Personal Information consistent with this Privacy Policy, and (b) not use or disclose your Personal Information for any purpose other than providing us with services or products for which we contracted;

viii. With third parties with whom you choose to let us share information, for example,other websites or apps that integrate with our API or Services, or those with an API or a service with which we integrate;

ix. With Fundraisly subsidiaries and affiliated entities that provide services or conduct data processing on our behalf, or for data verification, data centralization, and/or logistics purposes. Any information relating to you that we provide to our subsidiaries and affiliated entities will be treated by those parties in accordance with the terms of this Privacy Policy;

x. With Service Providers that may now or in the future provide payment processing services on our behalf. Access to your Personal Information by these Service Providers is limited as set forth in paragraph 14 (a) (i) above;

xi. With vendors, consultants, marketing partners, and other Service Providers who need access to such information to carry out work on our behalf. Access to your Personal Information by these Service Providers is limited as set forth in paragraph 14 (a) (i) above;

xii. In response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, court, or legal process;

xiii. With law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with our Terms of Service or policies, or to protect the rights, property, or safety of Fundraisly or others;

xiv. In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company. We require that these parties (a) protect the privacy of your Personal Information consistent with this Privacy Policy, and (b) not use or disclose your Personal Information for any purpose;

xv. If we otherwise notify you and you consent to the sharing, and

xvi. In an aggregated and/or de-identified form that cannot reasonably be used to identify you. We use such data only in aggregate form, and our analytical Services do not record any Personal Information.

b. We may disclose Personal Information as follows:

xvii. To any person who, in our reasonable judgment, is authorized to receive Personal Information as your agent, including as a result of your business dealings with that person (for example, your attorney);

xviii. As required by law or ordered by a court, regulatory, or administrative agency;

xix. As we deem necessary, in our sole discretion, if we believe that you are violating any applicable law, rule, or regulation, or are otherwise interfering with another's rights or property, including, without limitation, our rights or property;

xx. To enforce our Terms of Service, this Privacy Policy, and any other applicable agreements and policies.

c. Fundraisly may disclose Personal Information where we believe in good faith that such disclosure is necessary or appropriate to protect our rights, property, safety, or the rights, property, or safety of others; to comply with legal processes; or to prevent fraud, security incidents, or technical issues. Disclosures may occur without prior notice if it is permitted by law.

d. Fundraisly does not sell for monetary consideration Personal Information as defined under applicable U.S. state privacy laws, except if it is permitted by law. Session replay tools operate only after consent, where required by law.

 

15. Sharing Information with Law Enforcement

a. Fundraisly is committed to cooperating with law enforcement while respecting everyone’sright to privacy. If Fundraisly receives a request for user account information from a government agency investigating criminal activity, we will review the request to ensure it meets all legal requirements before releasing the information to the requesting agency.

b. Furthermore, under 18 U.S.C. §§ 2702(b)(8) and 2702(c)(4) (Voluntary Disclosure Of Customer Communications or Records), Fundraisly may disclose user account information to law enforcement, without a subpoena, court order, or search warrant, in response to a valid emergency when we believe that doing so is necessary to prevent death or serious physical harm to someone. Fundraisly will not release more information than it prudently believes is necessary to prevent harm in an emergency.

c. Where required under applicable law, we will notify affected users of legally binding requests unless prohibited.

 

16. Network or Media Sharing 

a. Our Services may now or in the future integrate with other services that provide network-sharing features and related tools, allowing you to share actions you take on our Services with other applications, websites, or media, and vice versa.
